Dopes and bad policy
Well, what would you expect from a former bug exterminator who is fighting extermination? Tom Delay and his lawyers have argued that the judge assigned to his case cannot be impartial because of his political affiliations. The prosecutors then used the same argument after the first judge was force to recuse himself and the judge overseeing the next appointment was deemed to be an ardent Republican.
The Republicans and their religious wingnuts are great believers in electing judges because it allows them to use money to taint elections. In Texas, all judges are elected, therefore no judges can be viewed as impartial. Apparently there are no fair trials in Texas, all are tinged by politics to some degree.
The real problem is electing judges to the bench. America should have a policy in all states for judicial appointments – no elections.
